| Note 1 | Roles other than those indicated in shaded boxes are optional but may be included according to the circumstances of each appointment. |
| Note 2 | Settlor who may be an individual or entity situated anywhere in the world. |
| Note 3 | May be the settlor or his nominee and may be authorized to direct or advise the trustee in respect of distributions. Trust Deed may authorize ability to direct change of trustee and situs of trust or to direct the trustee in respect of investments. |
| Note 4 | May be individually named or described by class. Generally appropriate to provide wide discretions including power of alienation to protect from creditors, etc. Settlor may also be a beneficiary. Appointor (3) may be authorized to direct distribution of income and capital or appoint new beneficiaries. This person may also be a Managing Trustee or Advisory Trustee. |
| Note 5 | In some circumstances an overseas company may be deemed to be New Zealand Resident and liable for New Zealand company tax if the directors of such company exercise control from New Zealand or the centre of management is within New Zealand. No New Zealand company tax will be payable if a New Zealand resident company is a pure nominee and all income is attributable directly to the trust, or the company is appointed as a co-trustee of the trust, or a sub-trust. |
| Note 6 & 7 | Assets may be held either directly through the trust or through a limited liability company and/or custodian. |
| Note 8 | Settlor may provide for investment advisor or committee or individual or corporate nominee or Managing Trustee to direct Company, Custodian or Trustee on investments |
